meth activist, said the drop in purity signifies progress against meth
producers . . . The setback for the meth trade follows tight
restrictions by the United States and Mexico on ephedrine and
pseudoephedrine, ingredients in cold medicine that are used to make
meth . . . Bovett, the Oregon activist, said data showing the purity
of meth plummeting should send a message to policymakers. "We're
at a crossroads," Bovett said. "Either we can continue the
international will to make meth a thing of the past, or we can let up
on it, and watch that line go back up again."

Excerpt: Four years ago, market researcher Jonathan Robbin
sat down to estimate how much cold medicine a typical convenience
store in Oregon could legitimately expect to sell in a month. The
answer: about $40. But Robbin's 2001 study . . . found 84 convenience
stores in Oregon and Southwest Washington that sold more than $500 of
the potential methamphetamine ingredient each month . . . An
additional 31 other types of businesses - from tobacco shops to
restaurants and even a video store - rang up $500 or more a month,
when Robbin predicted their sales should be zero. One Portland smoke
shop made $4,300 in sales of pseudoephedrine pills a month. The
question of whether or not small mom-and-pop stores need to sell
pseudoephedrine to survive is at the heart of the ongoing debate in
Congress over how to regulate sales of cold medicine. On Wednesday,
the House Judiciary Committee approved a measure that would allow
convenience stores and other retailers to keep selling pseudoephedrine
products, as long as they kept a customer log and stored the products
behind the counter . . . Rob Bovett, an advocate of Oregon's new
pharmacy-only pseudoephedrine rules, said that Robbin's research shows
it would be a mistake to allow convenience stores to continue selling
pseudoephedrine products. Oregon confined the sale of those medicines
to pharmacies in May, which Bovett credits with a 79 percent decline
in meth-lab seizures. "This isn't rocket science," said
Bovett, the legal counsel to the Oregon Narcotics Enforcement
Association. "We know what works, we know what doesn't
work."

Excerpt: One main element in Sensenbrenner's bill differs
significantly from Feinstein's original proposal. Feinstein and Sen.
Jim Talent, R-Mo., had proposed allowing only pharmacies to sell the
pseudoephedrine products, with limited exceptions. The Sensenbrenner
amendment would allow any retailer to sell the products as long as
they are kept behind the counter. Rob Bovett, legal counsel to the
Oregon Narcotics Enforcement Association, said that change weakens the
bill significantly. Oregon last year required all stores to keep
pseudoephedrine products behind store counters. Bovett said meth lab
seizures fell 47 percent from November through April. In May,
Oregon went a step further and banned sales of certain pseudoephedrine
products by any business but a pharmacy. Bovett said lab seizures are
down 79 percent since then. Pharmacists are better equipped to prevent
diversion of cold medicines than convenience store operators, he said.
"The concern is that they're leaving these things in the
convenience stores," Bovett said. "We know from experience
in Oregon that that's a huge mistake."

governor's task force on meth - which lobbied for the law. The task
force got about 20 other lower-profile changes in state law -
including, for example, more funding for drug abuse prevention,
tougher penalties for meth dealers, money to expand drug courts as a
proven tactic to combat addiction and crime, and measures to control
other chemicals essential to meth making, Bovett said. Additionally,
Congress is moving to attack the international trade in chemicals that
are diverted to illegal drug production, he said. Efforts on both the
state and federal levels coincide with a withdrawal of opposition from
the pharmaceutical industry as drug companies devise new formulas for
their cold medications. Drug company opposition to Oregon's
prescription law dropped dramatically this year, Bovett added. "I
think we're making a lot of progress this year. I think we got most
all of the 20 things we needed from the state Legislature,"
Bovett said. "The beautiful thing is it is bipartisan, both at a
state level and the federal level."

came up for a vote in the House Judiciary Committee, lawmakers
literally had just one question: Did you take out the stuff the
lobbyists for the retailers didn't like? . . . Rob Bovett, an attorney
who works for Lincoln County and is on state narcotics task forces,
said it was clear to the police by 2003 that Oregon wasn't keeping
cold pills containing pseudoephedrine out of the hands of meth cooks.
"Smurfers" were hopping from store to store, buying packs of
Sudafed two or three at a time to turn over to meth cooks. "The
smurfers and the cooks told us, put (the pills) behind the counter,
and it will shut us down," Bovett said . . . (but now) they will
also find a lot more support if they want to further controls on cold
pills. "We're fine with about any and all restrictions on this
product," said Tom Holt, a lobbyist for the pharmacist's
association. Two years ago, his group had fought restrictions. But, he
conceded, "we were just wrong."
